Several Provisions of Shanghai High People's Court on Online Disclosure of Judicial Statistics （for Trial Implementation）

With a view to making it more convenient for the ordinary people to file lawsuits, being supervised by parties and the public, improving the transparency of judicial work and further building a first-class legalized business environment, our court has formulated Several Provisions of Shanghai High People's Court on Online Disclosure of Judicial Statistics （for Trial Implementation） in accordance with the related work arrangements and requirements of the Supreme People’s Court, which is hereby issued.

Article 1. The trial proceedings shall be open to the parties and their agent ad litem involved in the case through the online platform of judicial statistics disclosure set up by Shanghai High People’s Court. The ratio of litigation and closed cases, the claim settlement rate, the average time period of adjudication, and other judicial assessment statistics that reflect the quality and effect of adjudication shall be open to the public through the platform of judicial statistics disclosure.

Article 2. Open judicial statistics shall include, but not be limited to, the following statistics:

i. Basic statistics such as the number of accepted, concluded, and executed cases;

ii. Statistics that reflect the ratio of heard or/and executed cases and concluded cases within a certain period of time, such as the ratio of litigation and closed cases, the claim settlement rate, and the ratio of concluded cases in a limited time period of adjudication;

iii. The average time of filing, hearing, and execution of cases;

iv. The proceeding processes of filing, payment, trial, judgement of cases.

Article 3. Upon the completion of the important procedures of filing a case, paying litigation fee, hearing the case and making the ruling, the related trial proceedings shall be open to the parties and their agent ad litem involved in the case in a timely manner through the online platform of trial proceedings disclosure of Shanghai Courts, 12368 litigation service platform of Shanghai Courts (lawyer service platform), the China Judicial Process Information Online, the judgement documents of China’s courts online, the China’s adjudication online and other online platforms.

The judicial assessment statistics that reflect the overall quality and effect of adjudication shall be open to the public through the specific public platform of judicial statistics established by Shanghai High People’s Court website. The judicial statistics of the quality and effect of judgement concerning business, financial and land dispute cases closely related to the business environment shall be open (applied to all grass-roots courts) and shall be improved in accordance with the Supreme Court’s working demands.

Article 4. Judicial statistics are automatically acquired and collected by computers from the management system of trial proceedings disclosure of Shanghai Court. These statistics shall be inspected every month by the concerned courts and trial chambers to ensure the accuracy.

Article 5. The judicial statistics shall be promulgated in categories periodically on the online platform of judicial statistics disclosure where the public can select the starting and ending time of statistics to search relevant data.

Article 6. The issues concerning specific items, methods of statistics and disclosure of judicial statistics shall be consulted by the trial management office and the Research Office of Shanghai High Court together with concerned trial business chambers and then reported to the President Administrative Meeting to make a decision.

Article 7. The trial management office of Shanghai High Court shall be responsible for the explanations to the public’s inquiries about concerned judicial statistics.

These Provisions shall be implemented from the date of issuance.
